Thank you for using My Alliance Network (“M-A-N”). Your trust is important to us, which is why we’re committed to protecting the privacy and security of your personally identifiable information (“Personal Information”).

This Privacy Policy describes the types of information we gather and how we collect, use, and disclose that information, including your Personal Information, when you visit or use our M-A-N website, including any subdomains, and any other websites (collectively, our “Site”), our mobile, tablet, and other smart device applications, and application program interfaces (collectively, “Applications”), and all associated services (collectively, our “M-A-N Services”). Together, the Site, Application, and M-A-N Services are referred to as the “M-A-N Platform” in this Privacy Policy. This Privacy Policy also explains our information management practices, including how your information is safeguarded and the degree to which you may control the maintenance and sharing of that information. You can access our Platform in many ways, and this Privacy Policy will apply regardless of the means of access. (Any undefined term in this Privacy Policy (such as “M-A-N Account” and “Member”), has the same definition as in our Terms of Service). Your use of the M-A-N Platform constitutes acceptance and agreement with this Privacy Policy and any additional applicable terms.

 Please note that our M-A-N Platform is intended for use only in the United States of America (USA), all other use is prohibited. Accordingly, our privacy program is designed to comply with the laws of the USA and the individual U.S. States.

 

1. Information We Collect

A. Information you provide to us when using the M-A-N Platform

Account Information. When you sign up for a M-A-N Account, we require certain information such as your first name, last name, email address, business address, profile picture, industry Identification number, and certain professional information such as brokerage affiliation, associations, licensing history, and associated listings and sales (“Professional Information”).

Property Information. To use certain features of the M-A-N Platform, we may ask you to provide additional information, such as the property address and details of listings, and information about the surrounding neighborhood.

Payment Information. To pay for certain M-A-N Services, including a paid subscription, we may require you to provide certain financial information (like your credit card information) in order to facilitate the processing of payments.

Communications with M-A-N and other Members. When you communicate with M-A-N or use the M-A-N Platform to communicate with other Members, we collect information about your communication and any information you choose to provide.

Client Contact Information. You may choose to import the contact information of your Consumer clients or enter that information manually to access certain features of the M-A-N Platform, like inviting your client or contact to use M-A-N. 

Member Content. While using our M-A-N Services, you may upload, transmit, provide or create additional information while using that service (“Member Content”), as further detailed in the Member Content section below. 

Other Information. You may otherwise choose to provide us information when you fill in a form, update or add information to your M-A-N Account, respond to surveys, participate in promotions, communicate with our customer support team, or use other features of the M-A-N Platform.

Consumers on the M-A-N Platform: We may ask that our Consumer Members provide the personal information described below. This information is necessary to provide you our M-A-N Services.

 Account Information. In some cases, you may be asked to create a M-A-N Account. When you do so, we require you to provide certain personal information such as your first name, last name, email address, and mobile phone number (your “Contact Information”).

Communications with M-A-N and other Members. When you communicate with M-A-N or use the M-A-N Platform to communicate with other Members, we collect information about your communication and any information you choose to provide.

 Member Content. While using the M-A-N Platform, you may upload, transmit, provide or create Member Content, including personal tastes and preferences, information relating to your current home, and/or notes on your consumer needs.

 Other Information. You may otherwise choose to provide us information when you fill in a form, update or add information to your M-A-N Account, respond to surveys, participate in promotions, communicate with our customer support team, or use other features of the M-A-N Platform.

B. Information we collect when you use our M-A-N Platform

When you use the M-A-N Platform, we automatically collect personal information about the services you use and how you use them. This collection may include:

Usage Information. We collect information about your interactions with the M-A-N Platform such as the pages or content you view, your searches, your opinions and preferences, and other actions on the M-A-N Platform.

Log Data and Device Information. We automatically collect log data and device information when you access and use the M-A-N Platform, even if you have not created an M-A-N Account or logged in. That information includes, among other things: details about how you’ve used the M-A-N Platform (including if you clicked on links to third-party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, operating system version, configuration data, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the M-A-N Platform.

 Cookies and Similar Technologies. We use cookies and other similar technologies when you use our M-A-N Platform, use our Application, or engage with our email communications. We may collect certain information by automated means using technologies such as cookies, browser analysis tools, web beacons, server logs, and mobile identifiers. In many cases, the information we collect using cookies and other tools is only used in a non-identifiable without reference to Personal Information. For example, we may use the information we collect to better understand website traffic patterns and to optimize our website experience. In some cases, we associate the information we collect using cookies and other technology with your personal information. Our business partners may also use these tracking technologies on the M-A-N Platform. (You can disable cookies, limit the types of cookies you allow, or set your browser to alert you when cookies are being sent. Please refer to guidance provided by your individual web browser if you'd like help in managing your cookie preferences.)

Do Not Track Signals. While you may disable the usage of cookies through your browser settings, the M-A-N Platform currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application due to a lack of standardization regarding how that signal should be interpreted.

Geo-location Information. When you use certain features of the M-A-N Platform, we may collect information about your precise or approximate location as determined through data such as your IP address or mobile device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu.

C. Information we collect from public sources and third parties

M-A-N also collects certain information, including Personal Information that others provide about you when they use the M-A-N Platform, or obtain information from third-party sources and combine that with the information we collect through your use of the M-A-N Platform. This information may include:

Publicly Available Information: M-A-N collects information from public sources, such as county and state tax and property records, government agencies, and multiple listing services (MLS), or third-party services with whom we have contracted to collect this information on our behalf. We also collect certain publicly available Professional Information such as brokerage affiliation, associated listings and sales, and licensing

history. Most of this information is about properties, not people. But some information we collect, like the identity of a property’s owner or real estate license information, may relate to individuals.

Information from other Members. We may also obtain information about you from another Member and/or Consumer who uses the M-A-N Platform. For example, we may receive Personal Information, like your name and contact information, directly from your real estate agent. Likewise, if you are invited to use the M-A-N Platform, the person who invited you may submit Personal Information about you such as your email address or other contact information.

Third Parties: We do not control or supervise how the third parties providing your information process your Personal Information; any information request regarding the disclosure of your personal information to us by that third party should be directed to them.

More about Member Content. Member Content is information provided by a Member and/or Consumer to M-A-N and other Members and/or Consumers through the use of our M-A-N Services. Member Content includes the content contained in posts, video conferences, chats, files, and notes shared while using our M-A-N Platform.

Children’s Data. Our M-A-N Platform, including our Site and Application, is not directed to anyone under 18 and we do not knowingly collect any personal directly from children or anyone under 18. 2. How We Use the Information We Collect

We use, store, and process Personal Information to provide, understand, improve, and develop the M-A-N Platform such as to:

We process this personal information for these purposes given our legitimate interest in improving the M-A-N Platform and our Members’ experience with it, and where it is necessary for the performance of our commitment to provide the M-A-N Services to you.

We may also use information associated with your account, such as a unique identifier, for attribution or record-keeping purposes as part of our relationship with third-party partners. For example, if you click on an advertisement shown on our Site that takes you to a third-party partner and purchase a product from that third-party, we may pass a unique identifier to that third party partner in order to track that activity.

3.Sharing and Disclosure

M-A-N is committed to sharing information only when needed for a legitimate business or legal purpose, and then only with recipients who will protect it.

Your Contact Information: When you create a M-A-N Account, your Contact Information (including your name, email address, and mobile phone number) will be shared with other Users on the M-A-N Platform. In addition, certain M-A-N Services may give you the opportunity to connect with professionals and businesses. If you choose to do so, we will share your Contact Information with those entities and persons on your behalf.

Other information you ask us to share: We share information when you ask us to share it. For example, if you choose to contact a service provider on our M-A-N Platform, we will send them your name and contact information. Similarly, when you ask us to share your information, including personal account information, to that third party in order to provide the service you requested. Likewise, when you decide to message or post a note to an advertiser or User on the M-A-N Platform, we will share your message or note as directed. In addition, all such shared information is subject to our Rules of Conduct on the M-A-N Terms of Service.

When M-A-N contracts with a service provider to help operate certain M-A-N Services, we may give them access to certain information to provide that service and/or to make that service more seamless for you. These providers have limited access to your personal information to perform specific tasks on our behalf, and are contractually bound to protect your personal information and only use personal information in accordance with our instructions. Likewise, when M-A-N partners with other businesses to offer products and services to you, we may share information with those partners only as needed to provide those products and services.

Compliance, Preventing Harm, and Protecting Our Rights: We do not share personal information that directly identifies you (such as your name, email, or home address) with third parties for their own use without your consent, unless it is either required by law or we determine that disclosure is reasonably necessary to enforce our rights, comply with our legal obligations, or to protect our consumers or third parties.

Aggregate Data: We may also share anonymous or aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

Third-Party Integration and Advertising: When third-party technologies or social tools are integrated into our M-A-N Platform, those third parties may collect information when you use our M-A-N Platform. That information will be associated with your browser or device in order to serve more relevant ads on our Site or others. In addition, we may pass aggregate information on the usage of our Site to third parties, but this will not include information that can be used to identify you. We do not control or supervise how these third parties process your Personal Information and disclaim responsibility or liability for their activities. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

Merger or Acquisition: In the event of a reorganization, divestiture, merger, sale, or bankruptcy, we may transfer all information we collect to the relevant third party and will obtain your consent to do so if required by law.

Some of this information may be shared with other Members. For example, all messages and Member Content you share in a meeting or video conference, including Personal Information about you or others, will be available to all other participants in that meeting.

4. Your Choices and Controls

Consistent with applicable law, you may exercise any of the rights described in this section. In some cases, to exercise such rights, you must contact us directly. Managing your information. You may access and update some of your account information and preferences through your Account settings.

Correcting your information. You have the right to ask us to correct inaccurate or incomplete personal information about you (and which you cannot update yourself within your Account settings).

Data Access. In some jurisdictions, applicable law may also entitle you to request copies of your personal information held by us.

Data Deletion. In general, we retain your personal information for as long as reasonably necessary to provide you services, create and improve our M-A-N Platform, comply with the law, and to run our business. In certain jurisdictions, applicable law may also entitle you to request to have all your personal information deleted entirely. Please note that if you request the deletion of your personal information, M-A-N may retain information needed to complete our contractual obligations to you, resolve disputes, enforce our user agreements, protect our legal rights, and comply with technical and legal requirements and constraints related to the security, integrity, and operation of our M-A-N Platform.

Withdrawing Consent. If we are processing your personal information based on your consent you may withdraw that consent at any time by changing your Account settings or by sending a communication to M-A-N specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.

California Privacy Rights. California law permits Consumers who are California residents to:

Third-party sharing for their direct marketing: Obtain a list of third parties to whom we have disclosed their personal information (if any) for the direct marketing purposes of those third parties, as well as the type of personal information disclosed to those third parties. This request may be made once a year and is free of charge. Please note that M-A-N does not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.

Access to personal information. To obtain a report of the specific pieces and categories of personal information that M-A-N has collected about the Consumer, the categories of sources for that information, the business or commercial purposes for collecting the information, the categories of third parties with which the information was shared, and to request the deletion of that information under certain circumstances.

To make a request as set forth in the above sections, please contact support@myalliance.network .Please note that you must verify your identity and request before further action is taken. As a part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this email address.

No Sale of Personal Information.

We do not allow marketing companies, advertisers, or anyone else to access Personal Information in exchange for payment. Except as described above, we do not allow any third parties access to any Personal Information we collect in the course of providing services to Members. We do not allow third parties to use any Personal Information obtained from us for their own purposes, unless it is with your consent (e.g. when you access a third-party integration).

M-A-N uses certain standard advertising tools that require Personal Information (think, for example, Google Ads and Google Analytics). We use these tools to help us improve your advertising experience (such as serving advertisements on our behalf across the Internet, serving personalized ads on our website, and providing analytics services). Sharing Personal Information with the third-party provider while using these tools may fall within the extremely broad definition of the “sale” of Personal Information under certain state laws because those companies might use Personal Information for their own business purposes, as well as M-A-N’s purposes. For example, Google may use this data to improve its advertising services for all companies who use their services. (It is important to note advertising programs have historically operated in this manner. It is only with the recent developments in data privacy laws that such activities fall within the definition of a “sale”).

5. Security

M-A-N is committed to protecting the Personal Information you share with us. We utilize a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Information from unauthorized access, use, or disclosure. We are also continuously implementing and updating administrative, technical, and physical security measures to help further protect your Personal Information. We recommend you take every precaution in protecting your Personal Information when you are on the Internet. For example, change your passwords often, use a combination of upper and lower-case letters, numbers, and symbols when creating passwords, and make sure you use a secure browser. If you know or have reason to believe that your M-A-N Account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your M-A-N Account, please contact us at support@myalliance.network

6. SMS Terms

By requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting (“Opting In”) to receive one or more text messages (“Text Message Service”), you accept these SMS Terms, consent to the handling of your personal information as described in the M-A-N Privacy Policy, and agree to resolve disputes with M-A-N as described in our Terms of Service. Message and data rates may apply.

M-A-N will use reasonable commercial efforts to deliver our Text Message Services to the number you provide through compatible wireless carriers. M-A-N is not liable for delayed or undelivered messages. The short code we use for some Text Message Services may not be supported on all Carriers.

Opting In

By Opting In to a Text Message Service:

You expressly authorize M-A-N to use autodialer or non-autodialer technology to send text messages to the cell phone number associated with your Opt-In (i.e., the number listed on the Opt-In form or instructions, or, if none, the number from which you send the Opt-In, or, if none, the number on file for your account). You also authorize M-A-N to include marketing content in any such messages. You do not have to Opt In or agree to Opt In as a condition of purchase.

You consent to the use of an electronic record to document your Opt-In. To withdraw that consent, request a free paper or email copy of the Opt-In, or to update our records with your contact information, please contact us via the methods described in the Contact Us section. To view and retain an electronic copy of these SMS Terms or the rest of your Opt-In, you will need (i) a device (such as a computer or cell phone) with internet access, and (ii) either a printer or storage space on such device. If you withdraw your consent, certain features of our service may not be available to you. To update information on how we would contact you electronically, visit your Notification settings in your account settings.

You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to Opt In.

These SMS Terms still will apply if you withdraw the consent mentioned above or opt out of the Text Message Service.

After Opting In, in addition to the main messages the service offers, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your Opt-In.

About the Text Message Services and Opting Out

Message and data rates may apply. Unless otherwise noted, Text Message Services send multiple, recurring messages. M-A-N may terminate any Text Message Service or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these SMS Terms still will apply. Text STOP to any promotional message to Opt Out or if applicable update your “Notification” settings on your M-A-N account.

7. Update to this Privacy Policy

We are always reviewing our privacy practices to make sure they comply with this policy. Sometimes, we’ll need to update our Privacy Policy to reflect changes in our services, technology, and uses of data.
